Rack Harbor Hosting, LLC is a service provider that relinquishes all liability from services leased to its customers. In order to do this, Rack Harbor Hosting, LLC is compliant with 17 U.S.C. ยงยง 512, the US Online Copyright Infringement Liability Limitation Act (OCILLA). OCILLA, a part of the Digital Millennium Copyright Act (DMCA), exempts service providers from copyright infringement situations brought on by their customers. In order to qualify for this exemption, we (the service provider) must abide by the rules set forth in the DMCA.
In order for Rack Harbor Hosting, LLC to remain a neutral third party, we must abide by the rules set forth by the DMCA. The DMCA's sole purpose is to manage copyright infringement of digital content by the copyright holders. Methods used by copyright holders can vary to find, recognize and verify their content. Our customers, in full compliance with this policy shall not obtain and reuse, without proper consent, any digital content on services leased from us. DMCA takedown requests will be processed as they are received, resulting in forceful content removal and/or account disciplinary action for repeat offenders.
DMCA requests made to Rack Harbor Hosting, in reference to a customer's content, must contain a certain subset of information to classify the instance as copyright infringment. For example, if you (the customer) were to knowingly upload, display and/or allow download of a copyrighted song/picture or other digital media object, it could be subject to a legitamate DMCA request for takedown. Once this request is received, it is processed within a resonable amount of time, by Rack Harbor Hosting, LLC, in the form of content removal, warning letters (written or digital), account suspension or even account termination for repeat offenders. All DMCA requests and takedowns can be contested by the content poster in compliance with DMCA guidelines for review by both the copyright holder and the service provider.
For copyright holders that believe their intellectual content has been reused without consent, can submit a digital or written report to the below contact information. Note that requests must be submitted in the format set forth by the DMCA or they will be discarded as false abuse reports. Proper requests shall be processed within a reasonable timeframe and duplicate requests for the same case will be discarded.
